It is increasingly important for transactors involved in commercial and industrial property transactions to minimize potential environmental liability by conducting Phase I and Phase II Environmental Site Assessments and Baseline Environmental Assessments, as warranted. These assessments establish environmental site conditions and cleanup requirements prior to sale. Further, Due Care Plans establish operational protocols so that site contamination is not exacerbated by future site activities.
Likewise, buyers and sellers of residential and commercial properties where on-site sewage disposal systems and/or water supply systems are advised to have these systems inspected prior to the sale. In some jurisdictions inspections are required before the sale is approved.
